Terms of Service

1) Agreement to Terms

These Terms govern your access to and use of Voxelate’s services, websites, and applications (the “Service”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) Service Overview

Voxelate converts 2D images into 3D assets (e.g., GLB) using automated processing. You can upload images, generate 3D outputs, and preview the results. We may offer optional storage or history for your uploads and outputs.

3) Eligibility

You must be at least 18 years old to use the Service.

4) Accounts

• You are responsible for your account credentials and activity.
• Provide accurate information and keep it up to date.
• We may suspend or terminate accounts for violations of these Terms.

5) User Content, Outputs, and License

• You retain ownership of the images and other content you upload (“Input Content”).
• You retain ownership of the 3D assets generated from your Input Content (“Outputs”), subject to any third‑party rights in the Input Content.
• You grant Voxelate a worldwide, non‑exclusive, royalty‑free license to host, process, and display your Input Content and Outputs solely to operate, maintain, and improve the Service (e.g., processing, preview, delivery, optional storage). This license ends when deletion is complete across our systems, subject to routine backups and legal retention.
• Do not upload content you do not have the right to use. Do not upload images of minors.

6) Prohibited Conduct

• Violating laws; infringing, misleading, harassing, hateful, or explicit Content.
• Uploading photos of anyone without consent, or any images of minors.
• Reverse engineering, interfering with, or abusing the Service or its models.
• Scraping, bulk downloading, or replicating outputs to train competing services.

7) Payments and Refunds

Prices are shown before checkout and may change. Payments are processed by third‑party processors; we do not store full card details. Unless required by law, purchases are final. If you experience an issue, contact support@usevoxelate.com.

8) Automated Generation and Disclaimers

• Outputs are generated automatically and may contain artifacts or inaccuracies.
• Outputs are provided for creative/visual use; they are not medical, safety, or engineering advice.
• We do not guarantee specific results, fitness for a particular purpose, or availability.

9) Intellectual Property

The Service, including software, models, and content we provide, is owned by Voxelate or its licensors and is protected by law. Except for your Input Content and Outputs, you may not copy, modify, distribute, or create derivative works without permission.

10) Feedback

If you send ideas or suggestions, you grant us a non‑exclusive, worldwide, royalty‑free license to use them without restriction.

11) Third‑Party Services

We may link to or integrate third‑party services (e.g., payment processors). Their terms and privacy policies govern your use of those services.

12) Termination

You may stop using the Service at any time. We may suspend or terminate access for any violation of these Terms or for risk to the Service or users. Upon termination, Sections 8–16 survive.

13) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS, ACCURACY, OR NON‑INFRINGEMENT. VOXELATE DOES NOT WARRANT UNINTERRUPTED OR ERROR‑FREE OPERATION.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXELATE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.

15) Indemnification

You will defend, indemnify, and hold Voxelate harmless from claims, losses, and expenses (including attorneys’ fees) arising from your Content, your use of the Service, or your violation of these Terms or applicable law.

16) Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. You consent to jurisdiction and venue in the state and federal courts located in Delaware.

17) Changes to the Terms

We may update these Terms from time to time. We will post the updated Terms and revise the “Last updated” date. Material changes may be communicated via email or in‑app notice. Your continued use constitutes acceptance.
